About these terms
AutoCap is a service for automatic captions and subtitles at theautocap.cc, operated by AKASH ASHOKBHAI MANGUKIYA, Satellite Road, Mota Varacha, Surat 394101, Gujarat, India (“we”, “us”). You can reach us at support@theautocap.cc.
By creating an account or using AutoCap, you agree to these terms, our Privacy Policy and our Refund and Cancellation Policy. If you use AutoCap for an organization, you confirm that you’re allowed to accept these terms for it, and “you” includes that organization.
Some parts work differently for consumers in the European Union, the European Economic Area, the United Kingdom and Switzerland, and we point these out where they matter. Nothing in these terms limits rights you have under laws that can’t be changed by a contract.
Who can use AutoCap
- You must be at least 16 years old.
- If you’re under the age of majority where you live (18 in most places), you need a parent or guardian’s permission to buy a paid plan.
- You can’t use AutoCap if the law where you live prohibits it, or if we’ve closed an account of yours before for breaking these terms.
Your account
- Give accurate information, and keep your email address up to date — it’s how we reach you.
- Keep your password safe and don’t share your account. Each account is for one person.
- You’re responsible for activity under your account, unless it comes from misuse by someone else that you couldn’t reasonably have prevented.
- Tell us straight away at support@theautocap.cc if you think someone has used your account without permission.
The service
AutoCap transcribes the audio of your videos with automated speech recognition, lets you edit and style the captions, and exports a video with the captions burned in, or SRT and VTT subtitle files. Video rendering and export happen in your browser.
- Free plan. The free plan comes with the limits shown on the pricing page, such as monthly transcription minutes, a maximum clip length and a watermark on exports. We may change the free plan, including its limits, at any time.
- Paid plans. What each paid plan includes is shown on the pricing page when you buy. If we make a change that significantly reduces what your plan includes, we’ll tell you in advance; it will apply from your next renewal, and you can cancel before then.
- Improvements. We keep improving AutoCap, so features change over time. We won’t reduce what you’ve already paid for during a paid period, unless we have to for security, legal or technical reasons — and then we’ll offer you a fair remedy.
AI transcription accuracy
- Transcripts and timings are produced by automated speech recognition from third-party providers. They can contain mistakes, especially with background noise, strong accents, overlapping speakers, names, jargon or poor audio.
- Always review and correct captions before you publish them. This matters most when you rely on them for accessibility, legal, medical, safety or other important purposes.
- You’re responsible for the captions and files you publish. We aren’t responsible for errors in automated output that you publish without checking — but this doesn’t limit our responsibility if the service itself doesn’t work as described.
Your content
- You own your content. Your videos, audio, transcripts, captions and exported files stay yours. We don’t claim any ownership of them.
- Permission to process it. So we can run the service, you give us a limited, worldwide, non-exclusive, royalty-free permission to host, copy, process and transmit your content only as needed to provide, secure and support AutoCap for you. This includes sending audio to our speech-recognition providers. The permission ends when you delete the content or your account, except for copies we must briefly keep for technical reasons or by law.
- No training. We don’t use your content to train AI models, and we don’t publish or sell it.
- You need the rights. You must own your content or have every permission it needs — including, where the law requires, the consent of people who can be heard or seen in it. Fonts you upload must be licensed for the way you use them.
- Keep your own copies. Your video files are kept in your browser, not on our servers, so they can be lost if you clear your browser data or change devices. Keep your original files.
Acceptable use
Don’t use AutoCap to:
- upload or process content that is unlawful, or that you don’t have the rights to use;
- infringe anyone’s copyright, trademarks, privacy or other rights — including recording or transcribing people without a consent the law requires;
- process content that sexually exploits children, promotes terrorism or violence, or harasses, threatens or defames people;
- break or probe our security, spread malware, or disrupt the service for others;
- copy, scrape or reverse-engineer the service, or automate requests to our API, except where the law allows it or we’ve agreed in writing;
- get around plan limits, the watermark or once-per-account offers, including by opening extra accounts;
- resell access to AutoCap or share your account.
If you break these rules, we may remove content from our systems, limit features, or suspend your account as described in Suspension and termination. If you believe content processed with AutoCap infringes your rights, email support@theautocap.cc with the details.
Paid plans, billing and cancellation
- Prices. Prices are shown in US dollars or euros on the pricing page. Checkout shows the final price, including any taxes that apply, before you pay.
- Payment processor. Payments are handled by our payment processor, whose name is shown at checkout. You may also be asked to accept its terms. We don’t store your full card details.
- Renewal. Monthly and yearly plans renew automatically at the end of each period until you cancel, at the plan’s price at that time. If the price changes, we’ll tell you before your next renewal, and you can cancel before the new price applies.
- Canceling. You can cancel at any time from your account page, or by emailing support@theautocap.cc from the address on your account. You won’t be charged again, and you keep access until the end of the period you paid for. After that, your account moves to the Free plan, and your projects stay in it.
- Refunds. Canceling is not a refund for the period you’re in. When we do give money back — including the 14-day right of withdrawal for consumers in the EU, EEA and UK — is set out in our Refund and Cancellation Policy.
- One-time purchases. One-time purchases, such as removing the watermark from one video, are paid once and never renew.
- Failed payments. If a renewal payment fails, your paid access may end when the current period ends.
Availability
- We work to keep AutoCap available and reliable, but we can’t promise it will always be available, uninterrupted or error-free. We sometimes need to pause it for maintenance or updates, and our providers can have problems too.
- If the service is unavailable for a significant part of a paid period, our Refund and Cancellation Policy explains how we put that right.
- If we decide to shut down AutoCap, we’ll give you at least 30 days’ notice where we can, and refund the unused part of any prepaid period.
Our intellectual property
- The AutoCap service, software, website, caption styles, templates and brand belong to us or our licensors, and are protected by intellectual property laws.
- While you follow these terms, we give you a personal, non-exclusive, non-transferable permission to use the service. You may use the videos and subtitle files you export, including the caption styles in them, for any lawful purpose, including commercial use.
- If you send us feedback or ideas, we may use them without owing you anything.
Other services
AutoCap works with services run by other companies, such as Google sign-in, our payment processor, and the platforms where you publish your videos. Their own terms and policies apply to your use of them, and we aren’t responsible for them.
Disclaimers
To the extent the law allows, AutoCap is provided “as is” and “as available”, and we don’t give warranties beyond those in these terms — for example, that automated transcripts will be free of errors, or that the service will meet every need you have.
If you’re a consumer, you have legal rights these terms don’t affect. In the EU, EEA and UK, for example, digital content and services must be as described, fit for purpose and of satisfactory quality, and services must be provided with reasonable care and skill.
Limitation of liability
- Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for gross negligence or willful misconduct, or for any other liability that can’t be excluded or limited under the law that applies to you.
- If you’re a consumer in the EU, EEA, UK or Switzerland: we’re responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. Loss is foreseeable if it’s obvious it will happen, or if both of us knew it might happen when you accepted these terms. We aren’t responsible for loss that isn’t foreseeable.
- Otherwise, to the extent the law allows: we aren’t liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, business opportunities or data; and our total liability for all claims relating to AutoCap is limited to the greater of what you paid us in the 12 months before the claim arose and 100 US dollars.
If you use AutoCap for business
If you use AutoCap for business purposes, you agree to cover reasonable costs, damages and legal fees arising from third-party claims caused by content you process with AutoCap, or by your breach of these terms or the law. This section doesn’t apply to consumers.
Suspension and termination
- You can stop using AutoCap at any time. To close your account and delete its data, email support@theautocap.cc from the address on your account, and we’ll do it within 30 days. Closing your account also cancels any paid plan, so it won’t renew.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect the service or other people from harm or fraud. Where it’s reasonable and allowed, we’ll tell you why in advance and give you a chance to fix the problem.
- If we close your account for any reason other than your breaking these terms, we’ll refund the unused part of any prepaid period.
- Parts of these terms that by their nature should continue after an account closes — such as content ownership, limitation of liability and governing law — continue to apply.
Governing law and disputes
- If you have a problem, please email support@theautocap.cc first. Most issues can be sorted out quickly that way.
- These terms are governed by the laws of India, and the courts at Surat, India have jurisdiction over disputes about them. For business users, those courts have exclusive jurisdiction.
- If you’re a consumer living in the EU, EEA, UK or Switzerland, you also keep the protection of the mandatory laws of your country of residence, and you can bring a claim in the courts where you live.
- If you’re a consumer anywhere else, this section doesn’t take away any right you have under consumer protection laws that can’t be waived, including any right to bring a claim where you live.
Changes to these terms
We may update these terms — for example, when we add features or when laws change. If a change is significant, we’ll tell account holders by email or in the app at least 14 days before it takes effect. If you don’t agree, you can stop using AutoCap and cancel any paid plan before the change applies; if you keep using it after that, the new terms apply. Changes never apply to the past.
General
- These terms, with the policies they mention, are the whole agreement between you and us about AutoCap.
- If a court finds part of these terms invalid, the rest stays in effect.
- If we don’t enforce a term straight away, we can still enforce it later.
- We may transfer our rights and duties under these terms to someone who takes over the service, and we’ll tell you if that happens; it won’t reduce your rights as a consumer. You can’t transfer your account without our agreement.
- These terms are written in English. If we provide a translation, the English version applies to the extent the law allows.
